Pre-order Terms

GENERAL PRE-ORDER TERMS AND CONDITIONS — HAPPY HEROES

1. Nature of the commitment (Firm Purchase) Pre-orders placed on this site are firm purchases of upcoming products. They guarantee you priority obtainment of an item and protect you against stock shortages. Just as Happy Heroes undertakes to order and reserve this item for you, you contractually undertake to complete its purchase.

2. Deposit When you pre-order, you pay for the item in full or by paying a deposit, whose percentage is shown on the product page.

• If you exercise your right of withdrawal (14 days, articles L221-18 and L221-24 of the French Consumer Code), from the order until 14 days after receiving the item, the deposit is refunded to you.
• If the sale is cancelled for non-payment of the balance (article 4), the deposit remains definitively acquired by Happy Heroes as compensation for the immobilisation of stock and to cover the administrative costs incurred.

3. Manufacturing Uncertainties and Delays The availability dates communicated are those provided by manufacturers at the time of listing. Pre-orders are subject to production uncertainties (manufacturer postponements, logistics delays). Happy Heroes informs you of any delay as soon as it becomes aware of it. If the announced delivery date is not met, you may require Happy Heroes to deliver within a reasonable additional period and, failing that, cancel the order in writing and be refunded within 14 days (Art. L216-1 to L216-6 of the French Consumer Code, Terms and Conditions 4.1); your right of withdrawal (article 2) remains intact.

4. Payment of the Balance and Shipping Pre-ordered items are shipped upon receipt in stock, in the chronological order of the pre-orders.

• An email is sent to you as soon as we know the arrival date of the goods.
• The balance (remainder of the price and, where applicable, shipping costs for the parcel) is charged automatically to the card saved with the order, when the item is shipped.
• If this charge fails, we notify you by email, then send reminders, so that you can update your card. Failing payment of the balance within 14 days of this first refusal, the sale will be terminated automatically: the deposit will be retained by Happy Heroes and the item will be put back on sale.

5. Shipping Costs and Shipments For an order that mixes pre-order items and other items (in stock, made to order, restocking), you choose at checkout (article 4.5 of the General Terms and Conditions of Sale): either a grouped shipment, in a single parcel sent when the pre-order items arrive, with a single shipping charge; or one parcel per group of items, each with its own shipping charge. The pre-order parcel's shipping is charged with the balance; the other parcels' is paid with the order.

6. Refund The sums paid are refunded in the event of withdrawal (article 2), subject to the return costs payable by you (article 5 of the General Terms and Conditions of Sale), and in full in the event of definitive cancellation of production by the manufacturer or Happy Heroes' inability to honour delivery (supplier allocation failure).
