1. Geographic Sovereignty and Importer Compliance

Happy Heroes delivers to 52 countries and territories. VAT included in the price (European Union and Monaco): France, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden. Outside the European Union and in the French overseas territories, any customs duties, local taxes and clearance fees are payable by you on delivery (for the United Kingdom, see article 4): Andorra, Faroe Islands, French Guiana, French Polynesia, French Southern Territories, Greenland, Guadeloupe, Guernsey, Iceland, Jersey, Liechtenstein, Martinique, Mayotte, New Caledonia, Norway, Réunion, San Marino, St. Barthélemy, St. Martin, St. Pierre & Miquelon, Switzerland, United Kingdom, Vatican City, Wallis & Futuna. The Canary Islands, Ceuta and Melilla are outside the EU VAT area: their taxes are also payable by you. Any other destination is not served: checkout refuses it, before any payment. The Customer acknowledges that they act as the final importer and assumes full responsibility for verifying that the items comply with the laws, standards and restrictions of their country. Happy Heroes reserves the discretionary right to suspend any shipment to areas classed as "high risk" by its insurers or providers, without notice.

2. Exclusivity of the Secure Flow (Anti-Loss)

For an order of less than €100 of items, you choose at checkout: home delivery without signature (offered by default), home delivery against signature, or a pick-up point where available, if each parcel fits within 30 kg and 64 × 40 × 38 cm. From €100 of items, delivery is made to your home against signature, except oversized parcels, delivered without signature (see Special cases). Each parcel is tracked online, with the carrier shown at checkout (Colissimo, Mondial Relay or FedEx depending on the country and weight). For delivery without signature or to a letterbox, the carrier's proof of delivery serves as proof of delivery, unless proven otherwise. In the event of an address error entered by the Customer, reshipping costs and return costs will be invoiced at the actual rate plus handling fees.

3. Ad Valorem Insurance and Subrogation of Rights

Each parcel priced on the scale is insured at its value, up to €5,000; insurance is included in the shipping shown at checkout. In the event of loss or damage before delivery, Happy Heroes refunds or reships the item, whatever the outcome of the carrier's investigation.

4. Taxation, Customs and Flow Interruption Fees

Sales to Switzerland are invoiced at the same price, French taxes included. The Customer alone is liable for customs duties, local VAT and customs clearance fees. United Kingdom: for delivery to Great Britain, your items and shipping are invoiced without French VAT (export). The £135 threshold applies per shipment: if the items in a shipment are worth £135 or less, UK VAT at 20% is included in the price you pay at checkout and collected by Happy Heroes (VAT no. GB049517888). Above £135 for a shipment, no VAT is charged at checkout for that shipment: UK VAT (20%), any duties and the carrier's fees are payable on delivery. For Jersey and Guernsey, your items and shipping are also invoiced without French VAT; local taxes may be charged on delivery. Northern Ireland is invoiced like a delivery within the European Union. Refused parcel: If the Customer refuses the parcel in order to avoid taxes, Happy Heroes refunds the price of the item and the standard outbound shipping costs; only the return costs and the import taxes and duties actually borne by Happy Heroes are deducted from the refund (Art. L221-24 of the French Consumer Code).

5. Lead Times and Force Majeure Clause

Preparation times (for an in-stock item: shipped the same day for an order placed before 12 noon on a working day, otherwise the next working day) and transit times (2 to 3 working days in mainland France and Monaco, 3 to 5 in Germany, Belgium, Luxembourg and the Netherlands, 4 to 7 in the rest of Europe and the United Kingdom, 4 to 9 in the French overseas territories) are given for information only. Happy Heroes is released from its delivery obligation in the event of Force Majeure within the meaning of French case law (carrier strikes, customs blockages, pandemics, cyberattacks). For shipments outside the European Union, customs clearance may extend the delivery time; the Customer's rights in the event of delay (Art. L216-1 et seq. of the French Consumer Code, Terms and Conditions 4.1) continue to apply.

How much does delivery cost?

Shipping depends on the weight and bulk of the parcel, its destination and the insured value. It is calculated and displayed before payment, at the Delivery step: no amount is added afterwards.

Amounts including VAT, in metropolitan France:

  • orders under €100: you choose between a pick-up point and home delivery; shipping depends on the weight of the packed parcel (item, carton and wedging);
  • orders of €100 and over: home delivery against signature, at the shipping cost shown at the Delivery step.

Shipping is rounded to 90 cents. Each parcel is insured at its value. Overseas and non-French destinations follow separate scales, displayed in the same way before payment.

Special cases

  • Several shipments: if your order mixes in-stock items, items to be received (made to order, restocking) or pre-order items, you can choose at checkout one parcel per group of items (Terms and Conditions, article 4.5). Each parcel has its own shipping; the pre-order parcel's is charged with the balance.
  • Direct shipping from Spain: some items ship directly from our supplier's warehouse in Spain. Their shipment has a flat rate of €24, only one per order, added to the shipping of the rest and still due if you collect your order. It is not offered to the French overseas territories, nor to the United Kingdom, Jersey and Guernsey.
  • Collection from our offices: for an address in mainland France or Monaco, you can collect your order free of charge, by appointment, in Marquette-lez-Lille.
  • Posters and art prints: they ship rolled, in a tube, unless they are framed, under a frame or in a box set.
  • Oversized parcels: a parcel longer than 100 cm, or longer than 150 cm when length, width and height are added together, is delivered to your home in mainland France by the carrier FedEx, insured at its value as in article 3, and delivered without signature, whatever the amount. Its shipping, shown at checkout, is based on the higher of its actual weight and its volumetric weight (length × width × height in cm ÷ 5,000, in kg). Beyond 120 cm for the longest side, 76 cm for the second, 330 cm in length plus girth or 70 kg charged, to Monaco, outside France, and for any item over 30 kg, delivery is on quote: write to us.
  • Parcels over 30 kg: a parcel over 30 kg including packaging, in which no item exceeds 30 kg, ships at the €120 flat rate in mainland France and Monaco; this flat rate does not include the value insurance of article 3.

6. Indivisibility of Shipping Costs and Logistics
Shipping costs are calculated on the weight/volume/value ratio. Happy Heroes reserves the right to consolidate or split shipments to optimise the security of the items. Any validated order is final: no merging of subsequent orders may give rise to a refund of shipping costs if one of the parcels is already being prepared.

7. Transfer of Risk (L216-4 and L216-5)

The transfer of the risk of loss or damage takes effect upon physical handover of the goods to the Customer or to a designated third party. Please note: If the Customer chooses a carrier other than those offered by Happy Heroes, the risk is transferred to the Customer as soon as the goods leave our warehouses (Art. L216-5 of the French Consumer Code (Code de la consommation)).

8. Crucial Receipt Protocol (Proof of Damage)

Upon delivery, the Customer is invited to inspect the security adhesive tape and the condition of the seals.

  • If the parcel has been tampered with: Refuse the parcel (recommended) or issue handwritten reservations precisely describing the damage (e.g.: "Parcel dented on right corner, tape torn").
  • The wording "subject to inspection" alone does not describe the damage: prefer precise reservations, which facilitate recourse against the carrier.
  • A signature without reservation does not deprive the Customer of their rights against Happy Heroes: the risks pass to the Customer only upon taking physical possession of the item (Art. L216-4 of the French Consumer Code). Report any pilfering found as soon as possible.

Before opening the seal: check the outside. On receipt, examine the item without opening the Happy Heroes protective seal: box, seal, visible condition. If something does not suit you, this is the time to exercise your right of withdrawal (14 days from receipt, return costs at your expense). If Happy Heroes provides you with the return label, its cost is deducted from your refund. Once the seal has been opened, a return remains possible. Only a depreciation resulting from handling beyond what is necessary to check the item (assembly, display, signs of use, missing parts…) may be deducted from your refund, after case-by-case review; its amount is justified to you before the refund. In the event of a defect not visible from the outside, the refund is made in full.

9. Transport claims

The Customer is invited to report any transport claim to Happy Heroes in writing, if possible within 3 days of receipt (excluding public holidays), to preserve recourse against the carrier (Art. L133-3 of the French Commercial Code). This period does not deprive the Customer of their rights against Happy Heroes, which bears the transport risks until the item is physically taken into possession (Art. L216-4 of the French Consumer Code). To facilitate processing, the Customer may in particular provide: photos of the parcel (inside/outside), a photo of the label, and a copy of the police report in the event of proven theft.

10. Digital Evidence (Video Sealing)

Happy Heroes archives, as far as possible, a preparation video of each order. This video records the condition of the item, its protection, its placement in the parcel and the application of the security seal. This video is a means of proof, in particular against "empty parcel" or "fake pilfering" fraud; the Customer may provide evidence to the contrary by any means.
